Terms of service

1. Who we are

Alkems (alkems.com) is a product of Alkemya, operated by Edwin Alejandro Jiménez Ramírez, an individual business owner in San José, Costa Rica ("Alkemya", "we", "us"). These terms are an agreement between you and Alkemya for the use of Alkems. Contact: support@alkems.com.

2. Who can use Alkems

You must be at least 18 years old and able to enter into a binding contract. If you use Alkems for a company, you confirm that you can accept these terms on its behalf.

3. Your account

You sign in with a link sent to your email or with Google. Keep access to your email and account secure, and tell us right away if you suspect unauthorized use. You are responsible for what happens in your account.

4. Plans, credits and payment

  • Alkems works with credits. One credit is worth one US cent. Each tool shows its price in credits before you create.
  • Subscriptions renew automatically each month or year until you cancel. Monthly plan credits renew each billing period and do not carry over. Credits from one-time packs do not expire while your account is active.
  • If a creation fails, the credits are returned to your balance automatically.
  • Payments are processed by our payment provider, which acts as the Merchant of Record for all our orders, handles billing and taxes, and processes refunds on our behalf. Its name appears at checkout and on your receipt. Prices are shown in US dollars and taxes are added at checkout where they apply.
  • We may change prices for future billing periods. We will tell you in advance, and you can cancel before the change applies.

5. Cancellations and refunds

You can cancel your subscription at any time from your account and keep access until the end of the period you paid for. Refunds follow our refund policy.

6. Acceptable use

You agree to follow our safety and acceptable use policy. In short: no sexual content involving minors, no non-consensual intimate imagery, no use of a real person's face or voice without their consent, no impersonation, no content meant to deceive people about what a real person said or did, no harassment, hate or violence, and nothing illegal. We moderate prompts, uploads and results automatically and may block content, remove it or suspend accounts that break these rules.

7. Your content

  • You keep the rights you have over what you upload ("inputs") and, to the extent the law allows, you own what you create with Alkems ("outputs").
  • You confirm that you have the rights to everything you upload, including the consent of every real person who appears in it.
  • You give us a limited license to store, process and show your inputs and outputs only to run Alkems for you, keep it safe and comply with the law.
  • We do not use your inputs or outputs to train AI models, and we do not sell them.
  • Outputs from AI may not be unique, and similar results may be created for other users. You are responsible for how you use your outputs, including checking that they do not infringe the rights of others before you publish them.

8. Real people and consent

Tools that use footage or images of people, including Transmut, may only be used with your own likeness, with the recorded consent of the people who appear, or with AI-generated characters. We may ask you to confirm consent and may refuse or remove content when it is missing.

9. AI-generated content

Creations made with Alkems are generated by AI models from third-party providers and are marked as AI generated where possible. Do not remove these marks or present the content as real footage of real events.

10. The service

We work to keep Alkems available and improve it, but we do not guarantee that it will be uninterrupted or error free. Models and features may change, be added or be removed. If a paid feature you rely on is removed, you can ask for a refund of the unused part of your purchase.

11. Suspension and termination

You can delete your account at any time from its settings. We may suspend or close accounts that break these terms, put others at risk or are used for fraud. If we close your account without a breach on your part, we will refund unused pack credits.

12. Disclaimers

Alkems is provided as is. To the extent the law allows, we disclaim warranties that are not stated in these terms. Nothing in these terms limits rights you have as a consumer that cannot be waived under the law of your country.

13. Limitation of liability

To the extent the law allows, Alkemya is not liable for indirect or consequential damages, and our total liability for any claim is limited to the amount you paid us in the 12 months before the claim. This does not apply to liability that cannot be limited by law.

14. Governing law

These terms are governed by the laws of Costa Rica. If you are a consumer, you also keep the protection of the mandatory laws of the country where you live, and you may bring a claim in its courts.

15. Changes to these terms

We may update these terms. We will post the new version here with its date and, for important changes, tell you by email or in the app before they apply. If you keep using Alkems after that, the new terms apply.
